DE PORCH resort’s company policy

In Order to make your stay as pleasant as possible, the Management requests your co-operation in observing the following as an agreement between the guest and DE PORCH resort (hereinafter called ‘Management’) under which rooms are permitted to be used by the guest(s):

  1. General Terms and Conditions
    1. The guest acknowledges responsibility for and on behalf of all parties on the premises to the terms and conditions of rental. Failure to comply with the rules of the property and the terms and conditions of this contract by any individual on the premises associated with the renter will be the sole responsibility of the renter and be considered a material breach of this contract. The guest further agrees to be responsible and liable for the actions and safety of every person in their group.
    2. Occupancy may not exceed what is posted for each home. The maximum occupancy includes children under the age of three years old.
    3. Guest understands to be fully responsible for the cost of any damages sustained to the property, décor or its contents during the stay; this includes the moving of items to another property, for breakages or for any excessive cleaning charges incurred during my stay.
    4. Smoking is not permitted in any accommodation managed by DE PORCH resort at any time. I understand that in the event that a guest is found to have smoked indoors the property, the guest will be contacted and informed of any charges related to the cleaning/deodorizing of the property and all of the items in the property (i.e curtains, furniture, window treatments, etc). These charges will be deducted from the security deposit made in advance on file.
    5. Guests may only smoke outside the accommodation and are responsible for disposal of waste in proper receptacles.
    6. All descriptions given on the website(s) are made in good faith and the owner(s) accept no liability whatsoever for errors or omissions.
    7. The reservation is accepted and confirmed only for the number of guests declared on the original inquiry and/or listed on the Rental Agreement. DE PORCH Resort reserves the right to cancel the reservation if additional guests are added without prior consent.
    8. Good Neighbor Policy: DE PORCH resort are located in a mixed-use neighborhood. We want you to enjoy your stay, but not at the expense of the neighbors so please be considerate of the neighbors with your noise and activities.
    9. No guest shall create or permit to exist any nuisance. Please respect the rights of the neighbors by restricting sound and noise to a reasonable volume.
    10. The accommodation is not to be used to host parties or social/group gatherings , without consent of Managmenent. Only guests whose names are on the Rental Agreement are authorized to stay in the home. Any guest having a party or social/group gathering in the resort or exceeding the numbers of authorized guests will be evicted without refund.
    11. Indoor furniture is not to be moved. Bringing rental furniture (except cribs) into the house is prohibited.
    12. Each bed has a total of one set of sheets. Should they need washing, please inform Management.
    13. The Guest making the reservation must be 21 years of age or older and must occupy the rental property, the entire term of stay for the reservation.
    14. Keys must be returned in person to Management upon departure. If lost, guest agrees to pay for lock repalcement.
    15. Guest acknowledges that neither DE PORCH resort nor the Owner of the Property’s insurance covers any of Guest’s or Guest’s invitees’ personal property, including vehicles, against loss or damage due to fire, theft, vandalism, rain, typhoon, water, criminal or negligent acts of others or himself, or any other cause, except for injury or damage caused by the negligence or willful misconduct of DE PORCH Resort or the Owner of the Property. DE PORCH resort and the Owner of the Property recommend that Guest carry or obtain insurance to protect Guest, Guest’s invitees and their personal property from any loss or damage.
    16. Check-in is at 2 pm and check-out is at 11 am.
    17. In the event a Guest fails to depart from the home by 11am with no late check-out arranged and results in DE PORCH resort being unable to clean and prepare the home for the next arriving Guest that day, the departing Guest agrees to pay damages and costs incurred by DE PORCH resort; including but not limited to moving the incoming Guest to another home. A late check-out can only be arranged at an additional charge if the home does not have another guest’s arrival schedule. This option must be arranged in advance and cannot be added on the day of departure.
    18. Reservation Policy
    19. You can conveniently make your bookings online via our website, or several boong sites (Expedia, Booking.com, AirBnB, Agoda, etc… or simply send us an email or call us.
    20. Before sending us your booking, please check that all of the information you have provided is correct and complete. Incorrect or incomplete information can result in an erroneous booking for which we take no responsibility.
    21. A deposit resp. a prepayment is required to secure your reservation (see also Article 4.). Once the booking has been processed, you will receive a reservation confirmation email that outlines a summary of your booking. Please review the information carefully and contact us immediately (deporchbolinao@gmail.com) if you have any questions or require any changes. This email will also include important information that we urge you to read to ensure your stay at DE PORCH resort is issue free.
    22. Please review our Cancellation Policy below. Securing your reservation with a deposit means you accept the terms of our Cancellation Policy.
    23. National ID/or passport must be presented upon check-in. Failure to do so would result in no acceptance/check-in.
    24. The total room cost including taxes is due upon check in at the resort.  DE PORCH resort accepts cash (Philippines Pesos, US Dollars and Euros). Traveler’s checks and credit cards are not accepted at the Resort. Alternatively you may pay your room balance via bank wire transfer prior to your arrival. Please contact us if you would like us to send you bank account details and wire transfer instructions. Payments must be received prior to your arrival date. Please ensure you confirm your payment with us via email.
    25. We ask that all of our guests purchase Travel Insurance, which is generally inexpensive, but can really save a lot of emotional distress if an unforeseen event occurs. We recommend your travel insurance will cover you for airline flight and accommodation cancellation especially during the typhoon season. We also recommend you are covered for accident, illness, medical evacuation and theft.
    26. Tariff
    27. The tariff is for the room inclusive of any government taxes.
    28. Meals and other services are available at extra cost.
    29. Settlement Of Bills
    30. Personal cheques are not accepted. DE PORCH resort only accepts cash payments or prepayments via bank wire.
    31. Deposit will automatically be decuted from the total amount of the accommodation costs’. For NO SHOWS deposit will be forfeited. DE PORCH resort reserves the right to cancel guests reservation if deposit has not been received on agreed date and time as stated on the confirmation letter received by email.
    32. Deposits and/or payments made through bankwire will occur a transfer cost which is covered by guest and not DE PORCH resort.
    33. Cancellation and Refund Policy
    34. Securing a reservation with a deposit means you accept the terms and conditions of our Cancellation Policy.
    35. Cancellations made more than 7 days from check-in date will not be charged.
    36. Cancellations made between 7 days from the check-in date and the check-in date will be charged the deposited amount resp. deposits are non-refundable.
    37. Should it be necessary for you to depart earlier than your confirmed date, you will be responsible for the full amount of your intended stay.
    38. There are no refunds for early checkouts.
    39. There are no refunds due to bad weather, tropical storms or typhoon’s; including any inconvenience or complication caused by a typhoon’s direct hit, near miss, or significant threat of a typhoon’s strike.  Typhoons are unpredictable by nature.  Please take out Travel Insurance to protect against these types of unforeseen events.
    40. DE PORCH resort is not liable for any other costs, evacuation or inconveniences caused by a tropical storm or typhoon.
    41. We strongly recommend cancellation and accident insurance to prevent any losses in case of illness, accident or otherwise.
    42. Departure

Check out time is 11am. Please inform the reception if you wish to retain your room beyond this time. Extension will be given depending on availability . If the room is available, normal tariff will be charged. On failure of the guest to vacate the room on expiry or period the management shall have the right to remove the guest and his/her belongings from the room occupied by the Guest.

  1. Guest’s Belongings

Guests are particularly requested to lock the door of their rooms when going out going to bed. Safety deposit boxes are provided in the room to store any valuables. The Management will not in any way whatsoever be responsible for any loss / or damage to the Guest’s belongings or any other property from either the hotel room or any other part of the hotel for any cause whatsoever including theft of pilferage.

  1. Pets
  1. Pets -small dogs only- are permitted in DE PORCH resort upon advance agreement with reservartions department.
  2. Guests with dogs are advised not to unleash their dog if it will not get along with DE PORCH resorts house dog or other guests for the duration of their stay.
  3. Guest understands that DE PORCH resort shall not be responsible for any loss or injury to a pet while staying at the property, or for any action take against the pet or pet owner by third parties.
  4. All pets must be under the complete control of a responsible guest, and must be on a hand-held leash at all times.
  5. The Guest agrees NOT to leave pet(s) alone TO ROAM FREELY THROUGHOUT THE ROOM. Kennels, crates or vehicles should be used to house pets when owners are not visually supervising pets.
  6. The pet owner pays a nightly rent fee for each pet of PHP 300 night/pet.
  7. Pets are not allowed on the furniture or beds.
  8. Guest agrees to pay the repair cost assessed by DE PORCH Resort for any damage done by a guest’s pet, including but not limited to chewing furniture, staining carpet (by urine), scratching glass, scratching doors, scratching walls, etc.
  9. Guests must pick up after their pet when the pet does its business on DE PORCH resorts property, and dispose of waste in a proper container.
  10. Guests must be able to provide certificate that the pet is up-to-date on rabies/all vaccinations.
  11. The Guest agrees to monitor pet’s noise so that neighbors resp. other guests are not disturbed.
  12. The pet owner agrees to indemnify, hold harmless, and defend rental owner against all liability, judgments, expenses (including attorney’s fees), or claims by third parties for any injury to any person or damage to property of any kind whatsoever caused by their pet(s).
  13. Guest’s Visitors / Day Visitors
  14. Visitors of In-house guests’ and regular Day Visitors are required to pay an entrance fee of Php 50.00 per person (of any age) and a fee of Php 100.00 per person (of any age) for use of Swimmingpool.
  15. Payment on day of arrival at the restaurant. No cheques or cards, only cash.
  16. No food and alcohol may be taken into the resort or restaurant.
  17. No private music is allowed to be played at resort’s area or around the pool by Day Visitors.
  18. Drunk and disorderly behavior will not be tolerated.
  19. Swimmingpool Rules and Regulations

The following rules and regulations have been established for the benefit of all users of the swimming facilities to assure the safe operation of the pools and to provide enjoyable recreational opportunities for all. Customers are requested to cooperate in observing these rules and to obey the instructions of DE PORCH resort staff. Customers violating swimming rules are subject to the revocation of their swimming privileges. No refunds will be given.

12.1 General Rules / Admission Policies

  1. Swimming pool is open from 06am to 23pm for guests.
  2. DE PORCH resort staff have the authority to enforce all pool rules. Customers who repeatedly violate the rules, may be ejected from the facility.
  3. No Lifeguard on duty. All guests using the pool do this at their own risk.
  4. The responsability for the children, their conduct and safety lies within the parents or guardians and not by DE PORCH resort staff.
  5. No one under age of fourteen (14) should enter the pool area without being accompanied by an adult who knows how to swim.
  6. Parents/Guardians/Supervisors (at least 18 years of age) must ACTIVELY SUPERVISE their children and keep young non-swimmers (seven years of age and under) within arm’s reach (“touch supervision”).
  7. Please leave valuables in your room. DE PORCH resort will not be responsible for personal property or valuables at any time or the loss of it.

12.2 Facility

  1. Food or refreshments may be consumed in designated areas of the outdoor pool.
  2. Glass containers, alcoholic beverages, drugs and pets are not permitted. Service animals are permitted in the pool area but not in the pool itself
  3. Employees are the only persons allowed in staff rooms, filter room, chemical storage areas and offices.
  4. Smoking is not permitted in and around the pool itself.
  5. The pool maybe closed and cleared periodically for a safety check or to apply chemicals, to adjust chemicals to ensure proper sanitation of swimming pool water.

12.3 Behavior

  1. No person within the pool area shall behave in such a manner as to jeopardize the safety and health of himself/herself and others. Such behavior, including abusive or profane language, shall be grounds for expulsion.
  2. Running, boisterous or rough play, pushing, acrobatics, dunking, wrestling, offensive or disruptive splashing or yelling, diving or jumping without care and caution, snapping of towels, improper conduct causing undue disturbances on or about the pool area or any acts which would endanger any patron are prohibited.
  3. Spitting, spouting water, blowing nose, urinating or defecating in the pool is prohibited.
  4. Gum chewing is not permitted anywhere in the pool area for health and safety reason. Top

12.4 Age & Health / Safety Restrictions

  1. Children under fourteen (14) years old must be accompanied by an adult supervisor (age 18+) who knows how to swim.
  2. Persons under the influence of alcohol or drugs will not be permitted in the pool area.
  3. Any injury occurring in the pool must be reported to DE PORCH resort staff immediately.
  4. All customers must take a cleansing soap shower before entering the water.
  5. Any person having a skin disease, sore or inflamed eyes, cold, nasal or ear discharge, communicable disease or who is wearing any kind of bandage or Band-Aid to cover an open (unhealed) wound will not be permitted in the pool.
  6. Any adult or child who is experiencing even a mild case of diarrhea may not use the pool.

 

12.5 Equipment / Toys

  1. Swim toys, balls and the like may be used at the discretion DE PORCH resort staff without disturbing other customers.

12.6 Weather / Environmental Conditions

  1. During rainstorms or thunderstorms, the outdoor pool may be closed and the entire area cleared of customers at the discretion of the DE PORCH resort staff on duty.
  2. Damage to Property

The guest will be held responsible for any loss or damage to the hotel property caused by themselves, their guests or any person for whom they are responsible.

  1. Limitation of Liability

DE PORCH resort and the Owner do not accept liability for equipment failure and/or services in the Property. In the event of failure of equipment, the Guest must notify DE PORCH Resort within one working day, such that DE PORCH resort may elect to rectify the failure. DE PORCH Resort and/or the Owner do not accept liability for lost or stolen personal property of the Guest from the Property during the rental period. In the event that property of the Guest is lost or stolen, the Guest should advise DE PORCH Resort first, and then contact the appropriate authority to report the lost or stolen items. DE PORCH Resort and/or the Owner accept no liability for personal loss or injury to the Guest during the rental period. The Guest must ensure that children are supervised at all times. It is the policy of DE PORCH Resort that all children under the age of 18 years are not left in the rental home un-supervised at any time during the rental period.

Games, toys, baby furniture/equipment, strollers, rental cribs are used at guests’ own risk. Young children must be supervised at all times. DE PORCH Resort and/or the Owner do not accept liability for equipment failure and/or services in The Guests understand that there is no lifeguard on duty and it is a major condition of this reservation that the use of the rental property and pool is entirely at the guest’s risk. Diving, horseplay or running around the pool area is prohibited; no child in the party or adult non-swimmer will use the pool without adequate adult supervision by a strong swimmer. The guest must immediately report any problems with the pool. All guests understand and agree that neither the property owner nor property manager can accept responsibility whatsoever in case of accident or illness whilst on the property.DE PORCH Resort does not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot, or other force majeure that may have a deleterious effect on the Guest. We cannot accept any liability for the failure of public supplies such as water, electricity, BBQ, gas or telephone/internet supplies. Nor for the consequences of the actions or omissions of persons who may supply or control main services, or any action taken in the vicinity of the property reserved, by any authority or persons over which we have is no control. We cannot accept any liability for the air conditioning system or any household appliance breaking down. Urgent steps will be taken for a local engineer to rectify any problem. We accept no responsibility of liability for any loss or damage or alteration in the terms of your reservation caused by events beyond our control, including, but not restricted to war, terrorist activity, civil commotion, flight delays or cancellations airport closure, adverse weather conditions, fire, flood or industrial dispute. There will be no credit given for shortened stays due to late arrival or early departure for any reason and no credit given for cancellation due to weather conditions. Failure to comply with any of the terms herein, will at the sole discretion of the Company, result in the eviction of the Guest from the Property, without recompense or refund.  There may be circumstances beyond our control and contemplation, in which the property might not be available for your reservation. Examples of these, but are not limited to, destruction of property, sale of property, water, gas or sewer leaks, fire or any other damage to the property making it inhabitable or potentially inhabitable.

In the event of Force Majeure, DE PORCH Resort will do their best to make alternative arrangements are not acceptable to you, then we will refund all monies paid. If the guest accepts the alternative accommodation, they agree to re-locate back to the original property when it is deemed available by DE PORCH Resort. This will be the full extent of our liability to you and we will not be responsible for any other costs connected with any such cancellation, howsoever arising.

  1. Managements’s Rights

It is agreed that the guest will conduct him/herself in a respectable manner and will not cause any nuisance or annoyance within the resort premises. The Management has the right to request any guest to vacate his/her room or other areas of the hotel forthwith, without previous notice and without assigning any reason whatsoever, and the guest shall be bound to vacate when requested to do so.

  1. Relation between Mangement and Guest

Nothing herein above shall continue or be deemed to constitute, or create any tenancy or sub-tenancy , or any other right to interact in the hotel premises or any part of portion thereof, in favour of any Guest or resident or visitor, and the Management shall always be deemed to be in full and absolute possession of the whole of the hotel premises.

  1. Government rules and regulations and application of laws

Guest are requested to observe , abide by confirm to and be bound by all applicable acts and laws and Government rules and regulations in force from time to time.

THE MANAGEMENT RESERVES TO ITSELF THE RIGHT TO ADD TO , OR ALTER OR AMEND ANY OF THE ABOVE TERMS, CONDITIONS AND RULES WHICH ARE A PART AND AN ABSTRACT OF THE LODGING ACT .
